Victim Disclosed Rape after Learning that Defendant Was in Prison for 2013 Sexual Assault & Robbery

(RIVERHEAD, N.Y.) – Suffolk County District Attorney Timothy D. Sini announced that a Patchogue man was sentenced yesterday to 20 years and six months in prison for raping a child who was under 10 years old in 2012.

“Victims of rape or sexual assault are often afraid to come forward and report their abusers to law enforcement, but we are here to help and protect you,” District Attorney Sini said. “In this case, police were not contacted until the victim knew this defendant was behind bars, and our office made sure that is where he is going to stay for a long time. This is a significant prison sentence and I thank Assistant District Attorney Laurie Moroff for bringing this sexual predator to justice.”

Gary Grigg, 31, pleaded guilty on April 19 to Criminal Sexual Act in the First Degree, a B felony; Rape in the First Degree, a B felony; and two counts of Sexual Abuse in the First Degree, a D felony.

During Labor Day weekend in 2012, Grigg engaged in sexual intercourse with a child who was under the age of 10 in his home, located at 265 West Main Street. The victim attempted to resist but Grigg was able to hold the victim down. Grigg then threatened the victim not to tell anyone about the assault.

In August 2016, the victim learned that Grigg was in prison for sexually assaulting and robbing a woman on Main Street in Patchogue on June 29, 2013. Grigg pleaded guilty on June 11, 2014, to Robbery in the Second Degree, a C felony, in connection with the assault. He was sentenced on Aug. 1, 2014, to 13 years in prison. Upon learning that Grigg was incarcerated, the victim disclosed the 2012 rape to a family member who contacted police.

Following an investigation by the District Attorney’s Office and the Suffolk County Police Department’s Special Victims Section, Grigg was indicted in October 2018.

Grigg was sentenced yesterday by Suffolk County Acting Supreme Court Justice Mark D. Cohen to 20 years and six months in prison followed by 20 years of post-release supervision. He was certified as a sex offender at the time of his guilty plea.

This case was prosecuted by Assistant District Attorney Laurie Moroff, Acting Deputy Bureau Chief of the Child Abuse and Domestic Violence Bureau.
